Limit of Liability

Thank you for choosing our services for your landscaping needs. Please carefully read the following terms and conditions regarding the warranty provided for the materials and services rendered:

1. Trees Warranty: Trees will be warranted for a period of 6 months from the installation date.

2. Shrubs, Ground Covers, and Vines Warranty: Shrubs, ground covers, and vines will be warranted 6 months from the installation date.

3. Exclusions: This warranty does not cover damage to plant material caused by animals, drought, insects, disease, frost, vandalism, fire, flood, storm, hail, or other acts of God.

4. Maintenance Requirement: For this warranty to be valid, the owner agrees to water and maintain the plant material properly. Failure to do so may void the warranty.

5. Transplants, Divisions, Bulbs, and Annuals: Transplants, divisions, bulbs, and annuals are not warranted. Transplanted trees, shrubs, ground covers, and annuals will not be warranted.

6. Inspection and Reporting: Plants in decline must be reported to the contractor for inspection before the loss of material and are only warranted for 6 months from installation.

7. Payment: Lack of payment for agreed services will void this warranty.

8. Irrigation Warranty: Irrigation systems for warranty materials have a warranty of one year to be free from original defects in materials and workmanship.

9. Winter Precaution: If freezing temperatures occur, the owner is responsible for turning off the irrigation system at the back flow device and blowing out all waterlines. Failure to do so will void this warranty.

10. Wood Structures Warranty: Any and all wood structures, such as patios, pergolas, or patio covers, will be warranted for one year.

11. Fencing Disclaimer: Any fencing installed has no guarantee due to the high winds in this area.

12. Earth Natural Material: Please note that earth natural materials, such as rock mulch, gravel, and existing dirt, have no guarantee. We cannot control how they decompose or the way they will settle and sink over time. There is no warranty when nature is the primary factor governing the behavior of these materials.

Project Maintenance

All seasonal irrigation maintenance is NOT included. All irrigation (Spring and Winter) starts at $99 and up, depending on what is needed and can be scheduled HERE.

Delivery of Services: Provider will provide all Services on or around date given at project acceptance, unless otherwise specified. Project dates are estimate start date and may not start for 3-6 weeks from projected start date. There are a number of factors on why project times can never be exact. Such as, staffing, material availability, weather and other projects add ons.

Exclusivity:Client understands and agrees that he or she has hired Provider exclusive of any other service provider. In order to provide a high level of satisfaction and quality of service, no other service providers, other than any assistant or third party that Provider hires to complete the Services outlined in this Agreement or bid estimate, are permitted to provide the same or similar services or products, paid or unpaid, at the locations and dates specified in this Agreement. 

Materials:Detailed landscaping proposes to furnish all material and perform all labor necessary to complete the work outlined in project estimate, unless other agreement is made in writing and attached to this agreement or noted in your plant and rock selections.Trees, Shrubs, Rock, Pavers and Block:Client will have all plants and rock selected from our plant and rock guide, this must be submitted no less than 7 business days before estimated project date.This plant guide has been perfected over the years, they thrive in our area and are generally available. Unsure of what it looks like? We suggest going to the nursery or rock yard on your own time soon, looking on each company's website, or a quick google search. If you do not see anything you desire for your project on our plant guide, please take time to select, purchase, and tag your plants at the nursery in advance. Things outside of this list below are CUSTOM and most likely NOT in the estimate. If you choose to find your own go in person to make your own selection, all plants, trees and shrubs must be selected and tagged at the nursery for pick up by Detailed Landscaping locally in Cedar City at Big Trees Nursery or Lady Bug Nursery. If you select your own, tag and pay in person, you MUST inform us 7 days before estimated project day. If not we will not know there are there. All Rock, Pavers and Block must be selected from Rocky Ridge in person or online.You may view each company for your selections on their websites. Please know, Detailed Landscaping does not meet customers at the nursery or rock yard for plant or rock selections. Provider only picks up for installation. FAILURE TO SUBMIT ROCK AND PLANT FORM MAY RESULT IN PROJECT SCHEDULE AND DELAYS.

Insurance:It is agreed that Detailed Landscaping will provide workers compensation and general liability insurance for the performance of this contract.
